Terms And Conditions, Registration Consent, and Cancelation Policy
This Agreement is between Sports Dry Needling (“Sports Dry Needling”) and seminar enrollee/applicant/attendee (“You”). This License Agreement and Terms and Conditions (“Terms and Conditions”) governs your use of Sports Dry Needling name/likeness, logos (“Marks”), material, and intellectual property upon your enrollment in a Sports Dry Needling Seminar (“Seminar”).
Please read the following Terms and Conditions carefully and click the box at the bottom of the page in order to agree to the Terms and Conditions, Registration Consent, and Cancelation Policy to complete registration. Please note that by checking the box that You are entering into a legally binding agreement with Sports Dry Needling, and You acknowledge and agree to abide by the Terms and Conditions.
If You do NOT accept and agree with ALL of the Terms and Conditions, do NOT continue with the enrollment for the Sports Dry Needling class.
Upon successful attendance and passing of any examinations in the Sports Dry Needling class, Sports Dry Needling grants You the right to use the materials and techniques learned in the class for use in your personal practice.
Upon successful attendance and passing of any examinations in the Sports Dry Needling class, Sports Dry Needling grants You a limited, non-exclusive, non-transferable, non-sublicensable, terminable license to use Sports Dry Needling Marks in connection with your professional practice.
Upon successful attendance and passing of any examinations in the Sports Dry Needling class, Sports Dry Needling will issue You the Continuing Education Credits (CEUs) equal to the amount of pre-determined teaching time in the class.
For Lower Extremity and Upper Extremity/Spine classes, 12 hours of CEUs will be issued. For the Maryland re-certification class, 3 hours of CEUs will be issued. Please note that all CEUs are approved through the state of Maryland and this does not guarantee that your state will accept the CEUs.
Sports Dry Needling has the sole discretion to determine whether to grant You the certification for the attended class and issue the CEUs. The certification automatically terminates in 36 months from the final day of the last seminar You had taken from Sports Dry Needling, at which time You will immediately stop any and all use of the Sports Dry Needling name and Marks, unless you renew the certification through a subsequent Sports Dry Needling seminar.
You are not able to: Teach, record for teaching, instruct, train, publicly demonstrate, or educate any of the content learned in conjunction with any Sports Dry Needling class, provide any material associated Sports Dry Needling classes to any educational or instructional institution/services of any kind, copy or distribute any material from the Sports Dry Needling class, or modify/change any material learned or printed in Sports Dry Needling class to use in education in any fashion.
You must maintain all required State Licenses and proper malpractice insurance policies (State mandated) throughout the term of the certification whenever and wherever You use the material learned at the Sports Dry Needling seminar.
Sports Dry Needling owns all the rights and interests to Sports Dry Needling’s name, logos/Marks, and materials. You may use them in a proper fashion (as determined by Sports Dry Needling, if issue arises), in your place of practice.
You will use the Trademark Symbol (TM), with any of the Sports Dry Needling Marks. You may not alter the Sports Dry Needling logos in any fashion.
You may not use Sports Dry Needling as part of a domain name, email, URL, homepage, or any use that could create confusion with www.sportsdryneedling.org.
You may not use any Sports Dry Needling name, logo, or any other association that shows Sports Dry Needling in disrepute.
You may not use any Sports Dry Needling name, logo, or materials in any fashion not covered by these terms and conditions.
You may use the Sports Dry Needling name, logos, and certification title (when awarded) in conjunction with practices in which you practice.
If you own multiple practices but do not work in one or more, you may not advertise any element or Mark of Sports Dry Needling at the involved location(s).
You will not attack, challenge, oppose, nor assist others in attacking, challenging, opposing any Sports Dry Needling intellectual property, including without limitation the Sports Dry Needling name, logos/Marks, and materials.
You are permitted to film/photograph portions of the seminar for Your own personal use, only.
You agree to not publish, share, or distribute any videos or photographs on any format without prior written consent from Sports Dry Needling.
You will defend, indemnify, and hold Sports Dry Needling harmless against any adverse actions arising from or relating to your professional practice, Your use/misuse of the Sports Dry Needling name, logos/Marks, material, and any intellectual property, or Your breach of the Terms and Conditions of this Agreement. Any unauthorized use of Sports Dry Needling intellectual property will cause Sports Dry Needling irreparable harm and entitle Sports Dry Needling to preliminary injunctive relief, in addition to any and all allowable remedies by legal means.
Should You breach the Terms and Conditions, Sports Dry Needling may terminate this Agreement.
Should You lose Your license to practice chiropractic, physical therapy, athletic training, medicine, or other healthcare license that allows You to perform dry needling, You will also lose your certification with Sports Dry Needling until you regain said license.
These Terms and Conditions supersede any express or implied agreement between You and Sports Dry Needling, except for those agreements already signed upon by an authorized Sports Dry Needling representative. These Terms and Conditions shall be construed in accordance with the laws governing the State of Maryland. The jurisdiction for any legal matter in regard to any dispute, claim, or controversy arising from or related to these Terms and Conditions, including without limitation disputes, claims, or controversies arising from Your unauthorized use of Sports Dry Needling intellectual property, will be the courts in Howard County, MD, or federal district court in Baltimore, MD. Sports Dry Needling’s failures to enforce any provisions of these Terms and Conditions on any one or more occasions shall in no event waive or impair any right of Sports Dry Needling on any future occasion. If any provision or any part of this Agreement becomes unenforceable for any reason, the remainder of the Terms and Conditions will still remain in full force and effect. The provisions of these Terms and Conditions which expressly state or by their nature survive termination, together with all provisions related to unauthorized use of Sports Dry Needling intellectual property, shall survive termination of these Terms and Conditions.
